a basically shot and killed near a middle school in berkeley. investigators have still collecting evidence at this hour. cbs 5 reporter cate caugiran tells us the sacramento street is shut down right now. cate. >> reporter: frank, michelle, that's right. if you can take a looker the crime tape is up here in this area. officers are still on scene gathering evidence and they have been here for quite some time. we do have video of when they first got on scene though. berkeley police tell us they got a caught around 11:30 last night and officers found a cyclist by longfellow middle school just off derby street. he fell off his bike along the sidewalk and he had at least one gunshot wound and was pronounced dead on scene. if you come back out live the award and sacramento streets, that crime tape is still up. there are several police officers here -- not officers, but rather cars here on scene continuing their investigation. and we want to make note that officers have not released a suspect description at this time. and they still don't have a

motive for the shooting. reporting live in berkeley, cate caugiran, cbs 5. one person in critical condition, two others serious after a shooting in oakland near lake merritt around 10:30 last night. officers found a 50-year-old man shot outside a liquor store on east 18th street. according to police, it looks like he may have been an innocent bystander. they found three more victims a few blocks away. san francisco police are trying to figure out who shot and killed a man in his 20s last night. officers found the man just before 8:00 near grove and buchanan streets. the man had been shot in the stomach and leg. he died at the hospital an hour later. we just saw cate in berkeley. the dry spell is over. a lot of rain is coming in now. >> let's get the latest from cbs 5 meteorologist lawrence karnow. >> for a lot of folks it gets

the blood pressure going again. this doesn't look as bad. still the rain in spots. it's dumping in some areas right now. you see on our high-def doppler radar, look at all the yellow off the coastline. that's going to be pushing onshore a little later on. this is not going to be as strong as that last series of storms. a closer look you can see that band of moisture through richmond, berkeley and concord. so good downpours there. but it is going to break up as we head into the afternoon. and we're not expecting to see any flooding from the storm system. here it comes right now. it's moving on through. that batch of moisture just off the coastline about to push onshore. so if you haven't seen rain yet, it's coming. so a messy commute early on this morning, but by the afternoon it breaks up. we may see a little bit of sunshine but temperatures fairly mild. a lot of subtropical moisture out there. so we'll keep you in the 50s and 60s. this may be it for the rain for a while. we'll talk more about that in a moment. gianna has traffic. >> that will be good news once of the rain is out of here. here's not the good news. we have trouble spots out

there. the accidents keep rolling in for chp. the first one is westbound 580 at lakeshore. two lanes are blocked. we are getting reports that one person may be trapped inside this vehicle. so emergency crews are on scene there. some delays as you approach the area. again that's westbound 580 at lakeshore so expect delays through there. also traffic alert highway 35 at ware road looks like two lanes are shut down one in each direction due to a tree in the road. no word on when the lanes will reopen. elsewhere new wreck reported north 880 at 7th street blocking the road. not too many delays yet on 880. northbound still quiet as you work your way towards the maze. but chp just arriving on scene of that accident. also couple of ones just came in. westbound 80 at san pablo blocking the road and 101 southbound at alemany reports of an accident possibly stuck in the right lane. now, the south bay checking in problem-free. one of our bright spots right now. you can see 101 we're still seeing a lot of green on our sensors. so far no delays along 101 or 280. now, let's get a live look at

101 at tully. we have a photographer standing by. you can see traffic light as you work your way through san jose. that's a look at your morning drive. back to you guys. traffic is moving through devil's slide again this morning. crews did emergency work yesterday to shore up the roadway along the san mateo coast because of erosion caused by last week's storms. a new tunnel is set to open next year and caltrans hopes that will finally mean and end to road closures in the area but some drivers don't want the new tunnel. >> devil's slide is the most beautiful drive that i have ever been over and i'm sad that the tunnel is opening and it's going to take away the scenery. >> drivers don't pay attention to the view. >> at least you shouldn't. the new tunnel south of pacifica is expected to open to cars in february or march of next year. in santa cruz county vine hill road might be open to some traffic later today. the road off highway 17 in scotts valley was washed out in

the weekend storm. a whole section of hillside actually disappeared in the storm taking the roadway with it. you can track the storm anytime on our website with our high-def doppler radar. that's at cbssf.com/weather. it is 5:06 now. the man accused of kidnapping and sexually assaulting a 16- year-old at risk girl is expected to make his first court appearance sometime today. this man here 36-year-old gary atkinson facing multiple charges including kidnapping and rape. the victim, a 16-year-old girl with autism who functions like a 7-year-old. >> this is by far one of the most sickening cases i have seen in my career as a police officer, that someone as mr. atkinson can take advantage of someone of this stature. >> a young girl walked away from a group home in coolidge avenue in oakland a week ago. police say atkinson met her near the fruitvale bart station and then forced her to his home here in san francisco where the

assault allegedly occurred. she was found on a muni bus two days later. san francisco police hope a new online tool will help them track down suspects in unsolved crimes. the line-up on the sfpd website shows surveillance video from cold cases including this violent robbery here on polk street. the line-up also includes descriptions of the crimes and suspects and ways to contact police to offer tips. >> that the public can basically reach out to us through social media and helping us identify who this suspect is. >> police got the idea after a san francisco giants fan smashed a bus following the world series. this widely circulated photo of the vandalism led to his arrest. this is a bizarre story. they held him captive, threatened to kill him and made him do home repairs. a handyman walked into a ambush in morgan hill and got himself out of the mess at a san jose gas station hours later.

the 50-year-old handyman was called monday morning for some work at a mansion in morgan hill. for the next six hours, a man and a woman allegedly attacked him and forced him to do work. >> you know, the victim was prettier it five-day forecast. he was shaken up and scared by this whole incident. he was pretty terrified. he said he was waiting for an opportunity to escape. >> that opportunity came when the suspects stopped for gas in san jose while taking the victim to do more repairs. he then called police and they caught the two suspects. both are due in court tomorrow. work resumes at the nation's largest port complex after a nine-day strike. negotiators reached an agreement to end the strike late last night. the details have not been released and it still needs to be ratified by union members. union workers were frustrated about employers outsourcing jobs. the strike shut down 10 of 14 cargo container terminals at the nation's busiest seaport complex in l.a.

>> going to get cargo moved throughout the supply chain in the country and get everybody those christmas presents that they are looking for in those stores. >> clerical workers who have been without a contract for two years walked out on the job more than a week ago and thousands of longshoremen refused to cross the picket lines. it is 5:08. contra costa county's board of supervisors have delayed a vote on whether to shut down four of their fire stations. if approved, stations in the cities of walnut creek, clayton, martinez and lafayette would all close january 1. the county's top fire official recommended the closures saying a loss of property taxes and failed tax measure in november caused the district to burn through its cash reserve. some other headlines around the bay on this wednesday. a decision on whether to buy a drone for the alameda county sheriff's office sent to the public protection committee for further study. the committee is expected to hold a public hearing on the issue sometime in january. if approved, it will go back to the board of supervisors for a final decision.

l.a. i go and take a picture. it's a ritual for us. not so good on the freeway. live look at the bay bridge toll plaza. we have lots of rain to contend with this morning. so slick surfaces. take it easy as you hit the roads. now, we have a couple of traffic alerts to report. the first one is on 580 westbound at lakeshore. two lanes are blocked. as a result, this is a two-car accident. we have injuries reported in the wreck. no word on when these lanes will be reopened but expect delays there. elsewhere, if you are heading around and about we have other accidents westbound 80 at san pablo dam road this accident reported in lanes first reported in the center divider but now it's blocking the left lane. traffic is slow through there. once you get past the accident not too bad on the bay bridge toll plaza. elsewhere, 880 northbound right at 7th street we have a two-car crash also stuck in the middle lanes. two trucks are involved in this accident. chp just headed to the scene. slight delays approaching the accident. no delays southbound on 880,

most of it is on the northbound side where the accident is. live look at 880 through oakland quiet traffic. delays once you approach the accident. south 880 no trouble spots into hayward or fremont. elsewhere, traffic alert reported in redwood city. highway 35 at ware road there are two lanes blocked one in each direction. this is for a tree down in the road. lots of activity there on scene. use an alternate until it's cleared. mass transit would be a great option today. bart, ace, muni, caltrain and your ferries all running on time. so you want to avoid the roads, bart is a great choice as well as muni. and a live look now at the san mateo bridge. so far not seeing any delays yet. a 14 to 15-minute ride to 880. that could change quickly with the rain. >> we are waiting for rain to move onshore. hi-def doppler showing you exactly where the rain is

falling right now and the heaviest right over the central bay. you can see that big patch of moisture off the coastline, that's going to be pushing onshore very shortly but in the meantime the heaviest amounts of rainfall stretching in right through san francisco and into the east bay. you have some very strong storms making their way into the concord area right now. if you are traveling in that area this morning, be careful. it's going to be raining heavily and may taper off. we have more rain on the way. still this morning starting out with some rain but i think by the afternoon the skies begin to part a little bit maybe a couple of leftover showers butotherwise we start to dry out. this is probably the last storm in quite a while. we're going to dry things out as we head in toward tomorrow and the coming days. but for today one last storm system dropping into the bay area. the good news is while it's a nice soaker it doesn't look to be a flooding rain so a nuisance rain coming through this morning for your commute but otherwise, traveling around the state you'll find showers up and down much of california and even some rain in the high sierra nevada. bases are pretty high but winter weather advisories up above 6500 feet or so.

expecting another 4 to 8 inches of snow above that period and then it looks like that will last until 10:00 this morning before those clouds move by. let's see if we can time it out a bit as the storm moves through this morning and then about 10:00 or so you will see more scattered showers becoming focused from san francisco southward and then in the afternoon that scoots out of town. then it looks like overnight things settle down. by tomorrow we have a lot of sunshine around the bay area maybe just some patchy ground fog. temperatures outside not going to be bad. again, this is subtropical in origin with the storm system so we'll keep you in the 50s and 60s. some 60s into the east bay and also in the north bay we'll keep those temperatures mild for this kind of storm. 50s and 60s. next couple of days, we'll watch weather settle down quit a bit. thursday and friday, no rain inside. in fact, the weekend look is good. lots of sunshine just some patchy fog in the morning hours. that's the latest. back to you. >> thank you. police say a man has implicated himself in a death of a new york subway passenger who was pushed on to a track.

surveillance video from monday's incident shows the victim in a confrontation with the suspect shortly before he was shoved on the tracks at the times square station. the victim was hit by a train and then killed. witnesses say the man desperately tried to climb back up to the platform but was unable to make it. >> just standing in fear and shock not knowing what's going on. some ran out, others just stood there. >> some witnesses say they noticed the suspect acting strangely before the incident. investigators say he frequented the area often, helping street vendors. it's not clear how he implicated himself. 5:18 now. lawmakers on capitol hill now have less than four weeks to avoid the dreaded "fiscal cliff" we have all heard about. if democrats and republicans don't reach a budget agreement by year's end, across-the-board tax hikes and budget cuts will kick in automatically. house speaker john boehnered off a republican proposal this week but president obama and

good morning, it's wednesday, december 5. i'm michelle griego. >> hi, everyone. i'm frank mallicoat. nearly 5:30 now on your wednesday. drivers have got a wet commute this morning. let's get a quick look at the weather with lawrence. >> yeah, guys. getting stormy outside right now. in fact, a good batch of moisture just about to push onshore. our high-def doppler radar is showing you that rainfall. it will be picking up. some places already seeing moderate to heavy rainfall. but look at the yellow and orange. that batch is just about to make its way in along the peninsula. we'll talk about that plus the prospects for dry weather coming up. we continue to follow some developing news in the east bay. someone shot and killed a bicyclist near a school in berkeley. cbs 5 reporter cate caugiran is outside longfellow middle school where investigators are still on the scene. cate. >> reporter: actually they just wrapped up and law enforcement has just left a minute ago. but we got off the phone with the coroner's office who

wouldn't confirm the gender of the victim. police haven't released a suspect description and we don't know a motive in the shooting. but we have video of the scene earlier if you take a look. berkeley police say they got the call right at around 11:30 last into the. she cyclist was found near longfellow near derby street. the victim was shot once and pronounced death on the scene. we are hoping for the public information officer to come out but we are told that we might get an update within the hour or the next half hour. so we'll keep you updated as we get more information. live in berkeley, cate caugiran, cbs 5. four people in the hospital this morning following an overnight shooting near lake merritt in oakland. officers found a 50-year-old man shot outside a liquor store on east 18th street just before 10:30 last night. they found three more victims a few blocks away. one person is in critical condition. three others are listed in

serious. san francisco police are trying to figure out who shot and killed a man near grove and buchanan streets last night. officers found the man in his 20s just before 8:00. he had been shot in the stomach and leg. he died at the hospital an hour later. flooding from the new storm has some people -- the threat of flooding from the new storm has some people putting out sandbags. we just checked with pg&e. it's dealing with scattered outages around the bay area this morning with about 500 customers without power. the largest outage is in san rafael, up in the north bay. but here we go again, i guess huh. lawrence said the rain is coming and here it is. >> we have more rain back in the bay area. the good news is this doesn't look like the type of storm that we had over these past few days so we are going to see the rainfall out there probably more of a nuisance rain than anything else. it's going to be a messy commute. no getting around that. we have a strong batch of storms about to push onshore. look for yourself on our cbs 5 high-def doppler radar. you can see all the yellow and orange just off the coastline. some of that make its way into

the san francisco area right now. we have had some patches strong showers moving onshore right now. in richmond heavier rainfall so we'll see that rain on and off throughout the morning hours but i think by the afternoon, we are going to start to catch a break. the storm is going to be falling apart as it moves across the bay area so we get the rain this morning. i think become partly cloudy into the afternoon, showers tapering off and mild temperatures. you will see 50s and 60s outside. maybe one, maybe two inches of rain in the heaviest parts of the bay area. not expecting any flooding but if you are headed on the roads treacherous out there, gianna. >> it sure is, lawrence. in fact, we have a slew of accidents out there this morning especially in the east bay. four accidents blocking lanes. first one reported at lake show at westbound 580 a traffic alert. chp is on scene. two vehicles involved in the accident blocking two right lanes. at one point one person was trapped inside the vehicle. that person has been taken to

the hospital. so westbound 580 at lakeshore two lanes remain blocked. chp working to clear that out of the road. you're seeing delays in both directions. other trouble spots, west 80 at san pablo dam road. they closed lanes to clear it. they now reopened lanes. there is still activity off to the side. traffic is slow as you approach the scene. not too far from there on the flip side east 80 at gilman we have reports of an accident. this one is also stuck in the roadway. and west 24 at old tunnel road a wreck also reported here. this one no word on any injuries just yet. it is also blocking lanes. traffic as you can see some yellow there on our sensors so speeds just under 40 miles per hour. traffic work continues near redwood city highway 35 at ware road. two lanes shut down one in each direction for a tree down in the road. we have lots of crews on scene trying to clear that out of way. so busy. 5:34. you're likely to find delays through the devil's slide area

on coolidge avenue in oakland a week ago. police say atkinson then met her near the fruitvale bart station and allegedly forced her to his home here in san francisco. she was found on a muni bus two days later. a bay area handyman, strange story here, held hostage, beaten and then forced to make repairs. it started in a home in morgan hill on monday ended hours later at a san jose gas station. police say the 50-year-old handyman got a call to a mansion near morgan hill. for the next six hours, a man and a woman allegedly beat the handyman, threatened to kill him and forced him to do some minor repairs at the house. the victim had done some work for one of the suspect's mothers two months ago. >> the work wasn't performed to the likes of the suspect's relative at the time and on top of that there was a dispute over services rendered, the victim wasn't paid entirely. >> the suspects apparently were taking the victim to do more

work for the relative when they were stopped at a san jose gas station to fill up. he then got away and called police. those suspects are due in court sometime tomorrow. contra costa county's board of supervisors are delaying a vote on whether to shut down four fire stations. they include ones in walnut creek, clayton, martinez and lafayette. if approved the closures will go into effect january 1. it comes after the district's burned through its cash reserves because of a loss of property taxes and a failed tax measure in november. the contra costa fire district serves 600,000 people over 300 square miles. more stations could close this summer. san francisco police hauled a load of marijuana and pot growing equipment out of a house that burned in the haight- ashbury neighborhood. it took firefighters an hour to put the fire out on page street. several residents were displaced but no one was injured. more protests in egypt

its telephone protocol. i bet it is. the duchess is still being treated for morning sickness and palace officials say she is feeling much better. >> i wonder if they did it live on the air. >> i bet they did. >> hello, the queen mum. >> that's bad. well, stock futures are rising this morning. 45 minutes ahead of the opening bell. some good news there. ashley morrison of cbsmoneywatch.com joins us on a wednesday. it's hump day. good morning. >> reporter: good morning. well, asian markets got a lift this morning after chinese government officials signaled more stimulus efforts. tokyo's nikkei rose half a percent while hong kong's hang seng gained nearly 2%. wall street investors are still waiting on a "fiscal cliff" deal. stocks were mostly unchanged yesterday. the dow lost 13 points while the nasdaq was down 5. fedex is offering some employees a voluntary buy-out plan as the package delivery company tries to save nearly $2 billion in the next three years. fedex will offer some employees up to two years pay to leave the company.

most of the cuts will come from its express and service units. and starting in 2016 the whole host of disney characters are coming to netflix. the online video rental service landed exclusive rights to stream disney movies before they air on premium cable networks. netflix will also stream some of disney's classic movies. no financial terms of the deal were released. but certainly a big score there for netflix. >> that is a big coup. >> i have a cousin who drinks starbucks every day. now i know what to get her. >> this would make her have a lot of clout there around starbucks, as well. they are introducing a $450 gift card. the starbucks metal car is made of etched steel and comes with only $400 on it. the reason why it's $450, you ask? it costs $50 just to make this steel card. >> are you kidding me? >> no, i'm not kidding you, frank.

that is going to be moving onshore bringing some moderate to heavy amounts of rainfall. already we have seen a train of moisture moving onshore into parts of san francisco sliding through the central bay. you can see the moderate to heavy rainfall already falling there and there is more to come. so we're not done with the rain yet but this is probably the last storm we'll see in quite some time. rain this morning around the bay area making for a messy commute. we're not expecting any flooding. by the afternoon partly cloudy skies, maybe a couple of leftover showers and dry weather returns as we head into tomorrow and for the foreseeable future. so rain a cold front diving into the bay area latched on to a little subtropical moisture so the temperatures fairly mild outside right now mainly 50s and 60s. you will find rain in the sacramento valley 58 degrees, 65 degrees and showers into fresno. the high country probably some rain at lake level and tahoe but you get higher and, well, it turns to snow about 6500 feet up to 7,000 feet expecting four to eight inches up there so be careful traveling in the high country.

bring the chains if you are heading that way timing out the storm a bit. cold front sliding through the bay area about 11:00 or so, most of that about san francisco on southward into the afternoon the skies beginning to part a little bit. then it looks like we'll begin to see the rain move eastward. we'll dry out towards tomorrow and i think the biggest concern looking over the next couple of days will be some of that tule fog, ground fog outside the morning hours. temperatures 50s and 60s into the south bay. east bay into the 60s by this afternoon. and in the north bay we'll keep you in the 50s and 60s. 60 in san francisco, 62 santa rosa. so this probably is it for the rain for some time as we'll see high pressure trying to build back into the bay area. dry weather on thursday and friday and dry through the weekend too, gianna. >> well, that is good news because this rain is making a mess of our morning commute. we have a handledful of accidents to report this morning so if you are heading out the door give yourself some extra time. the first trouble spot is a traffic alert south 101 at silver avenue the right lane closed as they clear the road. we are seeing a bit of a backup

as well so slow and go conditions in that area. use 280 at an alternate instead. elsewhere if you are work your way westbound 580 much better news. that traffic alert at lakeshore has now been cleared out of the road. traffic still sluggish as a result. also west 80 at san pablo dam road they have this accident over to the right shoulder but check this out. some yellow and red there on our sensors so traffic is very slow and go. in fact, we're seeing delays all the way back from at least highway 4 at this point. you're going to see brake lights when you hit university and gilman. accidents in the area as well, the first at university blocking one lane. it's a minivan stuck on its roof. the other accident eastbound 80 at gilman also blocking the road. westbound 24 we had an accident first reported there at old tunnel road. chp says it's on the eastbound side of 24 so the non-commute direction. still slow anyway westbound 24 as you work your way to the caldecott tunnel and into the maze. northbound 880 clear. south 880, though, at jackson, reports of flooding in all lanes. so traffic is very slow and go

as you approach the area this morning. better news though in redwood city. that traffic alert on highway 35 at ware road, they got that tree out of the roadway, both directions are now open so traffic should be running smoothly as you work your way through there. let's get live look at some conditions around the bay area. first, the san mateo bridge. so far one of our bright spots, no delays looking good actually between 880 and 101. that's like about a 14 to 15- minute ride. elsewhere a live look at conditions as you work your way along 580. now, we are seeing lots of brake lights through the altamont pass. pretty typical this time. morning. but again, as you work your way towards the dublin interchange, brake lights as well, no accidents or stalls, at least that's the good news through there. that's a look at traffic. back to you. >> all right, gianna. thank you. it's official, nudists are no longer allowed to bare all on san francisco streets. the board of supervisors gave the final okay to the city's new public nudity ban. several opponents stripped naked in protest. they were escorted out of the board chambers in blankets. the ban takes effect in
